What is RERA and Why Does It Matter in Bihar?
The Real Estate (Regulation and Development) Act, 2016 (RERA) is the law that protects home buyers across India. Bihar implemented its RERA authority (BRERA) to oversee all residential and commercial projects above a certain size.
Before RERA, property buyers in Bihar had almost no legal recourse when builders delayed projects, changed specifications, or sold properties multiple times. RERA changed this fundamentally.
What RERA Makes Mandatory for Bihar Builders
- Registration: Every project with more than 8 apartments OR more than 500 sq metres of land must be registered with BRERA before any advertising or booking is taken.
- Escrow account: 70% of all buyer payments must go into a separate escrow account.
- Quarterly updates: Builders must upload quarterly progress reports and images on the BRERA portal.
- Defect liability: Builders are liable to fix any structural defects reported within 5 years of possession — at no cost to you.
How to Verify a Bihar RERA Registration
- Visit the official Bihar RERA portal (brera.bihar.gov.in)
- Search by project name, promoter name, or RERA registration number
- Check that the project is active and not expired
- Review the declared completion date — this is legally binding
What Happens If a Builder Delays Your Project?
Under RERA, if a builder delays possession beyond the declared date, you are entitled to interest at the SBI prime lending rate + 2% for every month of delay. You can file a complaint on the BRERA portal — the authority must hear and decide the case within 60 days.
